Which OS are you running FFS under? One or both? How are volumes from 2 OS's made available to the system running FFS? Is the drive shared between both systems? Try deleting the Recycling Bin on the DESTINATION DRIVE (not the source). Perhaps it will be called $RECYCLE.BIN.
